Article 2 — General terms

2.1. The use of the www.negostore.ro Site, including accessing it, browsing it and placing Orders, implies the Client's warranty that they have reached the age of 18 and have full legal capacity. The sale and delivery of alcoholic beverages to minors are prohibited by law.

2.2. NegoStore reserves the right to amend this document at any time, without prior notice. The version applicable to an Order is the one available on the Site at the time the Order is placed.

2.3. The User/Client is solely responsible for the activity carried out through their account and for the consequences arising from the use of the Site.

2.4. The Client may not revoke their acceptance of these Terms and Conditions during the performance of the Contract or for as long as they have outstanding payment obligations towards the Seller, with the exception of consent to the processing of personal data, which may be withdrawn at any time (such withdrawal having effect only for the future).

2.5. Communication with the Seller may take place via the e-mail address info@negostore.ro and through the other contact details published on the Site.

Article 3 — Subject matter of the contract

3.1. The subject matter of the Contract consists of the Products ordered by the Client and confirmed for delivery by the Seller.

3.2. The Order must contain the sale price, the payment method and the payment term. The absence of any of these elements does not invalidate the Contract, insofar as the terms remain verifiable and the consequences are clear to the parties.

3.3. Ownership of the Products shall pass upon full payment by the Client, at the place of delivery, as confirmed by the signature of receipt on the courier's delivery document or by the acceptance document issued by the Seller's staff.

Article 4 — Prices and payment methods

4.1. The prices displayed on the Site are expressed in Romanian lei and include VAT and all applicable taxes, except for the delivery cost, which is displayed separately before the Order is finalised.

4.2. Prices may be changed at any time, without prior notice. The applicable price is the one displayed at the time the Order is placed.

4.3. Where a price reduction is displayed, the reference price is the lowest price applied by the Seller for the same Product during the 30 days preceding the application of the reduction, in accordance with GEO no. 34/2014.

4.4. Restriction on the purchase of alcohol. Alcoholic beverages may be purchased only by persons who have reached the age of 18. The Seller and/or the courier may request an identity document upon delivery in order to confirm age. Delivery may be refused or cancelled if the recipient is found to be a minor or refuses to prove their age, without any liability on the part of the Seller.

4.5. Payment methods:

  • Online by card, via Shopify Payments, under secure conditions (0% fee for the Client);
  • Cash on delivery (cash or card, upon delivery) – a processing fee may apply, shown in the shopping cart before the Order is placed;
  • Payment order / bank transfer, on the basis of the pro forma invoice, to account RO71 INGB 0000 9999 1733 8771 (ING Bank).

4.6. Card details for online payments are collected and processed exclusively by the authorised payment processor. NegoStore does not store full card details and is not responsible for the terms and policies of the payment processor.

4.7. Order confirmation. The automatic registration of the Order (the acknowledgement e-mail) does not constitute acceptance of the Order. The Contract is deemed concluded only upon the Seller's confirmation of the availability of the Products and of the delivery. The Seller may unilaterally cancel an Order, without any obligation and without compensation, in situations such as: listing or pricing errors (e.g. a price of “0.00” due to a system error), stock unavailability, incomplete/incorrect Client data, non-acceptance of the transaction by the issuing bank, or well-founded suspicions of fraud/bad faith.

4.8. The Seller reserves the right to refuse to perform an Order placed by persons with a problematic payment history or with non-compliant or bad-faith conduct.

4.9. Promotional campaigns. Coupons, vouchers and discount codes are subject to their own rules of use, validity periods and any minimum order thresholds, as communicated in each campaign.

Article 5 — Delivery

5.1. The Products are delivered exclusively within the territory of Romania, through partner courier companies, within the limits of their operational capacity.

5.2. The estimated delivery time is communicated during the Order placement process and/or in the confirmation e-mail. The Seller exercises reasonable diligence to meet delivery times, without guaranteeing an exact time that depends on the courier.

5.3. The delivery cost is displayed separately, before the Order is finalised, and is borne by the Client. Delivery within the territory of Romania is free of charge for Orders of 300 lei or more, the value being calculated after the application of discounts, including discount codes. The rates in force are displayed on the Payment & Delivery page. The Seller may also run temporary free delivery campaigns, announced on the Site.

5.4. Age verification upon delivery. The courier is authorised to request an identity document. A parcel containing alcoholic beverages shall not be handed over to persons who cannot prove that they have reached the age of 18. In the event of refusal, the parcel is returned to the Seller, and any related transport costs may be deducted from the amount to be refunded, in accordance with the law.

5.5. The risk of loss of or damage to the Products passes to the Client at the moment when the Client (or an adult third party designated by the Client, other than the courier) takes physical possession of the Products.

5.6. Upon receipt, the Client is encouraged to check the integrity of the parcel. Any visible damage should be reported to the courier and to the Seller as soon as possible.

Article 6 — Right of withdrawal (returns)

6.1. In accordance with GEO no. 34/2014, the consumer Client has the right to withdraw from the Contract, without penalty and without giving any reason, within 14 calendar days from the date on which the Client (or a third party designated by the Client) takes physical possession of the Products.

6.2. To exercise the right of withdrawal, the Client shall inform the Seller by means of an unequivocal statement (e.g. an e-mail to info@negostore.ro), optionally using the model withdrawal form provided by law. The deadline is met if the notification is sent before the 14-day period expires.

6.3. In the event of withdrawal, the Client shall return the Products without undue delay and no later than 14 days from communicating their decision. The direct cost of returning the Products is borne by the Seller, through the courier chosen by the Seller. The Client requests the return by writing to info@negostore.ro and stating the Order number; the Seller confirms the return and arranges the collection of the parcel. This provision is more favourable to the Client than the minimum laid down in Article 13(3) of GEO no. 34/2014.

6.4. The Seller shall refund the amounts received (including standard delivery costs) without undue delay and no later than 14 days from the date on which it is informed of the decision to withdraw, using the same means of payment as used for the initial transaction. The Seller may withhold the refund until it has received the Products back or until the Client has supplied proof of having sent them back.

6.5. The Client is liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

6.6. Exceptions to the right of withdrawal. In accordance with Article 16 of GEO no. 34/2014, the right of withdrawal does not apply, among others, to: sealed products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the Client after delivery; products which are liable to deteriorate or expire rapidly; products made/personalised to the Client's specifications. Unsealed/opened alcoholic beverages cannot be returned.

6.7. The practical return procedure, step by step, is described on the Returns page, which forms an integral part of this document.

Article 7 — Guarantees and conformity

7.1. The Products benefit from the legal guarantee of conformity under the legislation in force (GEO no. 140/2021 on the sale of goods to consumers). The Client is entitled to legal remedies in the event of a lack of conformity existing at the time of delivery.

7.2. The Seller is not liable for insignificant variations in appearance, label, vintage or packaging originating from the producer, provided that the nature and essential characteristics of the Product are respected.

7.3. The Products must be kept under the storage conditions indicated. The Seller is not liable for deterioration caused by improper storage or handling after delivery.

Article 8 — Complaints and dispute resolution

8.1. Any complaint may be sent to the e-mail address info@negostore.ro. The Seller endeavours to resolve complaints amicably within a reasonable time.

8.2. ANPC. The Client may contact the National Authority for Consumer Protection (ANPC) – www.anpc.ro.

8.3. ODR. In accordance with Regulation (EU) No 524/2013, the consumer Client may use the European platform for Online Dispute Resolution (ODR), available at: https://ec.europa.eu/consumers/odr.

8.4. This Contract is governed by Romanian law. Any disputes not resolved amicably fall within the jurisdiction of the competent Romanian courts.

Article 9 — Liability and force majeure

9.1. The Seller cannot be held liable for any indirect damage suffered by the Client as a result of using the Site or the Products in a manner contrary to their intended purpose or to the legislation in force.

9.2. The consumption of alcoholic beverages is at the Client's sole responsibility. The Seller draws attention to the fact that alcohol abuse is harmful to health and is not liable for the consequences of improper or illegal consumption (e.g. driving under the influence of alcohol, consumption by minors to whom the Client has facilitated access).

9.3. Neither party shall be liable for failure to perform its contractual obligations caused by a force majeure event, under the conditions provided by law.

10.2. Copying, distributing, reproducing or using the content of the Site for any purpose without the prior written consent of the Seller is prohibited.
